1. Introduction
This agreement forms an integral part of the relationship between Blue (Blue.Me) and the client. It governs the terms and conditions for using the hosting services provided by the company. The client’s request for or use of the service constitutes explicit acceptance of all the provisions stated herein.
Blue is committed to providing its services with the highest standards of reliability and transparency, ensuring the protection of clients’ privacy and data, and adhering to applicable Palestinian and international laws.
2. General Obligations of Blue
- The company undertakes to provide the agreed-upon service within two hours of receiving payment.
- The company commits to notifying the client of any updates or maintenance work that may affect hosted servers.
- The company guarantees the protection of the client’s personal data and will not disclose it to any party except upon an official request from governmental or judicial authorities, and the client will be notified immediately unless prohibited by law.
- The company guarantees an uptime rate of at least 99.9% and undertakes to compensate the client with an equivalent additional period in case the rate drops below that.
- The company commits to providing regular backups (daily, weekly, monthly, and external backups every two months).
- The company undertakes continuous improvement and technical development to ensure stable and secure performance.
3. Client Obligations
- Provide accurate and up-to-date information and update it upon any change.
- Pay subscription and renewal fees on time to avoid automatic suspension or deletion after 45 days from expiration.
- Use the service legally and in compliance with Palestinian and international laws.
- Maintain an external backup of the website and its files outside the server.
- Refrain from hosting or publishing content that violates religion, public morals, or applicable regulations.
- Do not exploit the server or hosting service for any harmful activity, hacking, spying, or sending unsolicited messages (Spam).
- Use the allocated space and services solely for personal or business use and not for resale or hosting third parties unless a written agreement is in place.
4. Payment, Renewal, and Cancellation
- The service will be activated after receiving the payment.
- The billing system sends a notification seven (7) days before the payment due date; if payment is not made by the last day, the account will be automatically deleted.
- A copy of the website may be retained for up to two weeks as a paid service.
- For dedicated server clients, the last payment date is the 25th of each month; the server will be automatically suspended on the 26th if payment is not received.
- The client must request cancellation before the 19th of the month to avoid invoice issuance.
- If cancellation occurs after invoice issuance, the full invoice amount remains due.
5. Pricing, Promotions, and Coupons
- The prices applicable at the time of subscription remain fixed for renewals unless a new agreement is made.
- Promotions and coupons are for new subscriptions only and do not apply to renewals.
- Discounts applied upon subscription do not automatically extend to renewals.
6. Website and Server Content
- The client is fully responsible for the legal and ethical content of their website.
- Hosting or distributing pirated or unlicensed software or materials is prohibited.
- Hosting of terrorist, politically hostile, inciting, pornographic, or violent content is prohibited.
- The company reserves the right to suspend or delete any site that violates these terms without prior notice.
7. Website Migration from Another Provider
Blue provides a free website migration service upon the first booking. However, due to differing provider policies, complete migration cannot always be guaranteed. The client bears responsibility for verifying the integrity of data after migration. A paid migration service can also be requested if needed.
8. Backup and Data Loss
- The company performs regular backups (daily – weekly – monthly – external); however, it remains the client’s responsibility to maintain a separate external copy.
- The company is not liable for data loss resulting from technical failures or unforeseen circumstances beyond its control.
- In case of backup recovery failure, the company will exert maximum effort to provide alternative solutions.
9. Attacks and Hacking
- Using the company’s servers to perform attacks or hacks against any entity is strictly prohibited.
- The company has the right to suspend service immediately upon detecting harmful activity without compensation.
- The company reserves the right to take technical and legal actions necessary to protect its network and other clients.
10. Shared Hosting and Resource Usage
- Shared hosting services are intended solely for hosting websites and may not be used as storage or archival space.
- Using the hosting space for file storage or internal backups within the account is prohibited.
- If the number of files or resource usage (CPU/RAM/Processes) exceeds allowed limits, the website may be temporarily suspended until usage returns to normal levels.
- Sending bulk emails exceeding the plan’s allocated limit is prohibited.
11. Fair Usage Policy
This policy ensures equitable and balanced use of resources among all clients. When usage exceeds normal limits, the company reserves the right to temporarily restrict the account, charge additional fees, or suspend service after notifying the client.
12. Privacy and Data Protection
- Blue is committed to protecting client data from unauthorized access using modern encryption and security technologies.
- No personal data will be disclosed without the client’s consent or an official order from a competent legal authority.
- The client has the right to request modification or deletion of their data unless restricted by legal obligations.
- In the event of a security incident, the company commits to notifying the client within a reasonable timeframe.
13. Technical Support
Technical support is provided through the ticket system or email 24/7. Support does not include fixing or maintaining the client’s scripts unless requested as a paid service.
14. Limitation of Liability
Services are provided “as is” and “as available.” Blue shall not be liable for any indirect damages or consequential losses. Any compensation, if applicable, is limited to the value of service fees paid for the affected period only.
The company bears no responsibility for official decisions or legal orders leading to service suspension, or for issues arising from external providers beyond its control.
15. Governing Law and Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of the State of Palestine. Any dispute shall first be resolved amicably within 30 days, and if unresolved, shall be referred to the competent Palestinian courts.
16. Amendments and Validity
Blue reserves the right to amend or update this agreement with prior notice to clients within a reasonable period. Continued use of the service after the amendment constitutes implied acceptance of the new terms.
